A quiet title action in Michigan is not something that can be done by filling out a few forms. It is much more complicated than that. It requires the skill, education, training and experience of a qualified lawyers skilled in both real estate law and in litigation. A quiet tile action is a lawsuit. Thus, all of the factors applicable to lawsuits, and all of the complexities, also apply to quiet title actions.

The action is most often brought by a current owner and is brought against those who may have an interest in the land or real estate. The lawsuit complaint alleges ownership and sets forth the circumstances leading to ownership and specifically identifies all parties who may have an interest (legal or equitable) in the property. The relief sought by the complaint is usually in the form of a confirmatory deed or a court order extinguishing the rights of those defendants identified.

Why is a Clean Title Important?

While it is possible to sell your home without a clean title it will greatly hurt the price that you will be receiving for your home and it will cause a number of unnecessary delays in the sale. Real estate investors or individuals want to buy homes as quickly as possible so they are able to start work on them immediately, live them , rent them out or get them back on the market for resale. Issues that will delay the sale or closing of a home such as an encumbrance (title not clean) will take time to resolve and time equals money. Having a clean title puts you as a seller in the best bargaining position because it makes you willing and able to sell without any slow down.

Combining Quiet Title Action With a Demand for Damages

Under common law, a land owner may sue another for “slander of title”. A slander of title lawsuit is difficult to prove since it requires proof of malice, a bad motive on the part of the Defendant, along with proof of special damages.

Quiet title actions can arise from a number of different scenarios. We work to untangle the issues surrounding your title through court intervention. Clients work directly with our real estate attorney who has successfully handled complex title issues resulting from:

   Unreleased mortgages
   Claims by a lien holder
   Illegal or improper property conveyance
   Tax deeds and obligations
   Unrecorded easements
   Adverse possession
   Boundary disputes or trespassing
Expired or unknown licenses for land use
